These Terms of Service ("Terms") govern your access to and use of all products and services provided by Twomiah Software Ventures ("Twomiah," "we," "us," or "our"), operated by Jeremiah Phillips, located in Eau Claire, Wisconsin. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
Twomiah provides software-as-a-service (SaaS) products and self-hosted software solutions for small businesses and individuals. Our products include but are not limited to: Twomiah Build, Twomiah Care, Twomiah Factory, Twomiah Vision, Twomiah IckApp, Twomiah Card Shop, Twomiah Ads, BreakReturns, and BreakerDisplays.
We may modify, update, or discontinue features of the Service at any time. We will provide reasonable notice where practicable for material changes.

We may offer a free trial period. Unless you cancel before the trial ends, your subscription will automatically convert to a paid plan and you will be billed accordingly.
By subscribing, you authorize recurring billing. Your subscription renews automatically at the end of each billing cycle (monthly or annually) unless cancelled.
You may cancel your subscription at any time via your account settings or by contacting support at support@twomiah.com. Cancellation takes effect at the end of your current billing period. You will retain access until the end of the paid period.
We may change our prices with at least 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
Except where required by applicable law, all fees are non-refundable. We do not provide prorated refunds for partial billing periods.
All payments are processed securely through Stripe. Twomiah does not store your credit card information directly on our servers.
You agree not to use the Service to:
We may investigate violations and cooperate with law enforcement where appropriate.
You retain ownership of all data and content you upload to our services ("User Content"). We do not claim ownership of your User Content.
You grant us a limited, non-exclusive, royalty-free license to host, process, store, and display your User Content solely for the purpose of providing and operating the Service.
You may request an export of your data at any time by contacting us. Upon account termination, we will retain your data for 30 days before permanent deletion, unless otherwise required by law.
While we take reasonable measures to protect your data, you are responsible for maintaining your own backups. We are not liable for any data loss except where caused by our gross negligence or willful misconduct.
For services that generate and deploy software on your behalf (e.g., Twomiah Build, Twomiah Care):
All Twomiah software, designs, logos, trademarks, templates, and content are the property of Twomiah and are protected by applicable intellectual property laws. You may not copy, reverse engineer, decompile, or resell any part of the Service without our prior written permission.

We will respond in accordance with the Digital Millennium Copyright Act and applicable law.
Our services integrate with third-party providers including Stripe, Render, Supabase, SendGrid, Twilio, Google Maps, Meta, Google Ads, OpenAI, Anthropic, and others. Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for the content, policies, availability, or failures of third-party services.

We strive for reliable uptime but do not guarantee uninterrupted or error-free service. We may perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for any downtime, interruptions, or service disruptions, whether planned or unplanned.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Twomiah and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.
Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
This limitation does not apply to liability arising from gross negligence, willful misconduct, or non-waivable legal rights.
You agree to indemnify, defend, and hold harmless Twomiah, its owner, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
We may suspend or terminate your access to the Service if:
We may also terminate for convenience with reasonable notice. We will not act arbitrarily or in bad faith.
Upon termination:
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law rules. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Eau Claire County, Wisconsin.
We may update these Terms from time to time. We will notify you of material changes via email or through a prominent notice in the Service at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
